Definitions

Consumer contract - a purchase contract, a contract for work, or other contracts, if the contracting parties are the consumer on the one hand and the supplier on the other hand, resp. seller.

Supplier / seller - is a person who acts within the scope of his business or other entrepreneurial activity when concluding and fulfilling a contract. It is an entrepreneur who directly or through other entrepreneurs supplies the buyer with products or provides services.

Buyer / consumer - is a person who does not act within the scope of his business or other entrepreneurial activity when concluding and fulfilling the contract.

Purchase contract - the buyer's order is a draft of the purchase contract and the purchase contract itself is concluded at the moment of delivery of the buyer's binding consent to this proposal (binding confirmation of the order by the seller). From this moment, mutual rights and obligations arise between the buyer and the seller.

By concluding the purchase contract, the buyer confirms that he has read these terms and conditions and that he agrees with them. The buyer is sufficiently informed of these terms and conditions before the actual execution of the order and has the opportunity to become acquainted with them. These business conditions are an integral part of the concluded contract.

A conclusion of the contract

The seller will receive from the buyer a draft contract (order), which the seller will confirm by e-mail to the address provided by the buyer. By confirming the order, the contract is concluded.

The contract is concluded in the Czech language, unless the circumstances on the part of the seller or the buyer prevent it, the contract can be concluded in another language understandable to both parties. The concluded contract is archived by the seller for the purpose of its successful performance and is not accessible to third parties. Information about the individual technical steps leading to the conclusion of the contract is evident from the ordering process in our online store and the buyer has the opportunity to check and possibly correct the order before sending it. These terms and conditions are displayed on the website of our online store and thus enables archiving and reproduction by the buyer.

At the request of the buyer, he will receive a copy for a handling fee of CZK 100contract (order and confirmation) sent by post, in case the buyer requires a physical copy of the contract. Otherwise, the sent order and its subsequent confirmation by the seller, or other relevant documents attesting to the conclusion of the contract (invoice, etc.)

Warranty of goods

Complaint goods

Depending on the type of defects and under the conditions stipulated by generally binding legal regulations, in particular Act No. 40/1964 Coll., The Civil Code, Act No. 634/1992 Coll., On Consumer Protection, and Act No. 513/1991 Coll. , the Commercial Code, as amended, the buyer has the opportunity to demand in the event of a complaint, especially that the defective goods be replaced with new goods.

According to the Civil Code - Title Five: Consumer Contracts, § 53, paragraph 8, letter c,) the consumer may not withdraw from the contract and exercise the right to return the goods without giving reasons within 14 days of receipt and to.c) the delivery of goods adapted to the wishes of the consumer or to his person, as well as goods which are perishable, worn out or obsolete.

The buyer has the right to withdraw from the contract within 14 days of receipt of the goods, provided that the suit was ordered in a standard size (table of standard sizes S, M, L, XL, XXL), which is only for the Lycra and Spandex category and assortment of the Nylon category, and without other parametric adjustments,   regardless of the method of taking over the goods or making the payment. This period is intended to acquaint the buyer to a reasonable extent with the nature, properties and functionality of the goods. The buyer is entitled to withdraw from the contract at any time before delivery of the goods. Withdrawal from the contract the buyer sends to the seller via email,by a letter delivered by the Czech Post, or handed over in person within a 14-day period. The buyer does not have to state the reason for which he withdraws from the contract. To facilitate communication, it is appropriate to state in the withdrawal the date of purchase or the contract number of the sales document, bank details and the chosen method of returning the goods. The seller is obliged to return to the buyer the amount fully corresponding to the price of the goods and the paid costs for its delivery within 14 days of withdrawal from the contract, to the account specified by the buyer in the notice of withdrawal from the purchase contract. If the seller offers several options within a certain method of delivery of goods, he is obliged to replace the cheapest of them to the buyer. No later than within the same period of 14 days, the buyer is obliged to send or hand over the purchased goods to the seller. The goods should be returned to the seller complete, preferably in the original packaging, must not show signs of wear or damage. For a quick and trouble-free settlement of withdrawal from the contract, the buyer is recommended to send the goods to the address Bonovo sro, Žižkova 968, 535 01 Přelouč. The buyer is advised, in his own interest, to insure the goods in case of damage or loss during transport and to bind the insurance indemnity in favor of the seller. The cost of returning the goods, including the recommended insurance, is paid by the buyer. If the returned goods are damaged by a breach of the buyer's obligations, the seller is entitled to claim from the buyer compensation for the reduction in the value of the goods and set it off against the amount returned.

The buyer cannot withdraw from the contract (it is an exception to the right to withdraw from the distance contract) if the goods are manufactured according to the consumer's requirements or goods adapted to personal needs. This exception is regulated in § 1837 letter d) of the Civil Code. Goods manufactured to consumer requirements are further defined in Article 2 of Directive 2011/83 / EU on consumer rights as "goods which are not prefabricated and which are produced on the basis of an individual choice or decision of the consumer". Recital 49 of the Directive cites as an example goods made according to the consumer's requirements or goods clearly tailored to personal needs, for which the consumer states the requirements (dimensions) or has requested specific characteristics (location of zipper, holes, etc.), then we can speak of goods that are basically unique and has been manufactured according to the individual wishes and requirements stated by the consumer.
